<br />Proposal to Enlarge Black Lake No, I <br /> <br />March 2005 <br />Page 8 <br /> <br />. <br /> <br />The District's proposal for operation of Black Lakes will maintain instream flows in Gore <br />Creek from the Vail Golf Course diversion to the mouth of Gore Creek in a more targeted <br />and effective manner than is possible under current operations, Operation ofthe systems <br />interconnect reduces the demand on the District's wells by 1.5 cfs and the Dowds <br />Junction intake will further reduce the demand by up to 4.46 cfs, resulting in a total net <br />benefit to the stream of up to 6,0 cfs, Under current operations, the maximum release <br />rate from Black Lakes is only 2,0 cfs, <br /> <br />REQUIRED PERMITS AND APPROVALS <br /> <br />The proposed second enlargement of Black Lake No, I will require several federal, state <br />and local pennits and approvals, These requirements are listed below, <br /> <br />[J The Forest Service Special Use Pennit for the first enlargement of Black Lake <br />No, I, approved by the U,S, Forest Service in 1992, will need to be amended <br />for the proposed second enlargement. The review and approval process for <br />this amendment will include preparation of documentation for NEP A <br />compliance including an Environmental Assessment. <br /> <br />[J AU,S, Anny Corps of Engineers, Section 404 Pennit will be required to <br />address potential impacts on wetlands and aquatic habitat. <br /> <br />[J In conjunction with the Forest Service Special Use Permit and the Corps of <br />Engineers Section 404 Permit, Endangered Species Act, Section 7 <br />Consultation with the D,S, Fish and Wildlife Service will be required, <br /> <br />. <br /> <br />[J A Colorado Water Quality Control Division 401 Water Quality Certification <br />will be required to assure compliance with Colorado water quality standards, <br /> <br />[J Review and approval of the plans and specifications for construction of the -- <br />dam and reservoir enlargement by the Colorado Division of Water Resources, <br />Office of the State Engineer was completed in September 2004. <br /> <br />[J The Eagle County 1041 Pennit for enlargement of Black Lake No, 1, <br />approved in 1991, may need to be amended for the proposed second <br />enlargement. <br /> <br />In addition to the foregoing, an amended MOA should be entered into between the <br />District and the Colorado Department of Natural Resources which addresses uses ofthe <br />enlarged Black Lake given the construction and use of the system interconnect and the <br />Dowds Junction intake and pipeline, <br /> <br />The District hopes to move forward with the applications and the permitting processes <br />listed above as soon as possible, <br /> <br />ENVIRONMENTAL IMPACTS AND MITIGATION <br /> <br />The District has conducted preliminary environmental investigations including <br />delineation of wetlands, a plant survey and evaluation of habitat for rare animal species, <br /> <br />. <br /> <br />Hydrosphere Resource Consultants, Inc., 1002 WahlUt St, Suite 200, Boulder, CO 80302 <br />
