<br />Only a few isolated populations of darters remain in Colorado in springs adjacent to Fountain Creek south of <br />Colorado Springs, as well as in Rush Creek and Big Sandy Creek. <br /> <br />Southern redbelly dace range throughout the central Mississippi River drainage with isolated populations in <br />Kansas, Oklahoma, Colorado and New Mexico, Only two self-sustaining populations are known to exist in <br />Colorado, One is in Pueblo County, The other is on Fort Carson in El Paso County, <br /> <br />Creek Watershed Study - The effort to complete the Scope of Work for the Corps Study for Fountain <br />Creek is still underway, The Study will address erosion and floodplain issues, At a meeting of the Fountain <br />Creek Task Force on May 3, Task Force members spoke with Corps staff in Albuquerque, The discussion <br />focused on the Scope of Work. In the coming months the Task Force and the Corps will work to fl11alize the <br />Scope of Work. At that point the Corps and Colorado Springs will be in a position to sign a formal <br />agreement and begin work. <br /> <br />The study is anticipated to take three to four years to complete, It will address the flooding, erosion, and <br />sedimentation issues raised by the 1999 flood on Fountain Creek, leading to identification of specific <br />problems and to recommendations for specific projects and activities to address those problems, The <br />estimated cost of $3,5 million over that three to four year period includes a 50% local/state cost share, Of <br />that $1.75 million share, the State of Colorado has committed $600,000 ($300,000 from the CWCB and <br />$300,000 will come from the Colorado Department of Local Affairs), The remainder will come from the <br />communities in the watershed, with the City of Colorado Springs providing the largest single share from a <br />local government, <br /> <br />Buena Vista Drop Structure: A citizens group in Buena Vista applied for a 404 permit and hired a <br />consultant build a "drop structure" in the Arkansas River within the Town's River Park for kayak recreation, <br />Concems about the project have been expressed by area rafting companies and the Division of Wildlife <br />because it has a 50-year easement contract (that expires in 2041) with Buena Vista, designating some 3000 <br />feet of the Arkansas River along the River Park exclusively for fishing, The proposed drop structure will be <br />in the middle ofthe 3000-foot reach, The Corps may issue a permit for the structure under a nationwide <br />permit. We have objected to using nationwide permitting authority to permit recreational facilities, <br /> <br />The project consists of a "U" drop structure (the curvature "c" faces downstream) with ungrouted boulders <br />placed at or below the existing channel invert and subsequently creating a pool for kayaking activities, The <br />drop structure will be designed to bypass 250 cfs without creating backwater. (The 250 cfs is the historic <br />minimum year-round flow recommendation that the DNR submits to Reclamation for the protection of <br />fishery,) Higher flows will overtop the sides of the structure, The entire structure will be under water at high <br />stages of the river. <br /> <br />The Town is considering assuming ownership of this structure and is in the process to updating a master plan <br />for the Arkansas River Park that will include addressing the concems expressed, <br /> <br />At this time, the parties are not considering filing for an RICD water right to avoid the cost oflitigation and <br />also because they see no need for a water right. They believe that the Arkansas River's minimum <br />streamflow requirement of 250 cfs will satisfy all their kayaking needs, They also believe they have a good <br />relationship with the Southeastern Water Conservancy District, <br /> <br />In the meantime, we need to discuss using nationwide permits for these types of facilities with the Corps, We <br />have urged all three district offices to notify us of any recreation-related applications in Colorado (both for <br />individual as well as for nationwide permits), We have also urged the Corps to require applicants to <br />simultaneously send the CWCB a set of copies of the application and materials they file with the Corps, <br />Once we know about applications and the location of projects, we can communicate directly with applicants <br />and resolve our concerns far more effectively, <br /> <br />14 <br />
