<br />make ~ecisions and are elected no longer have anything to do with it. <br />It is the appointed federal judges who are deciding policy, many of, <br />them extremely qualified and intelligent people, but many of them not <br />SO qualified. <br /> <br />This country is largely being ruled today by non-elected officials. <br />That is not democracy. We are so tied up here:'in -colorado tod~y with I <br />litigation that we can't see the end of it. We are caught in a con- <br />tinuing process. We understand now that new litigation is about to be <br />brought on the Dolores Project. ' We are facing a. lawsuit on everything. <br />We are already in, a lawsuit':on the Narrows. <br /> <br />Unless Congress determines new rules of venue and jurisdiction, the <br />litigation process will remain beyond anything we have experienced in <br />the history of this country. <br /> <br />I understand now that there is some congressional sentiment to limit <br />jurisdiction and venue and to prevent these class action suits. Today, <br />we are beset with the fact that there is some collusion going on in <br />some cases between the Justice Department and the environmentalists. <br />'In two cases 'that hashappene~ to us so :far. : <br /> <br />When we go to the 'Justice Department, sometimes we are just wasting our <br />time. The 'question is whether the governmental agencies are representing <br />the people any more or whether they are representing certain individuals <br />in the government who are representing certain special interest groups. <br />It is getting to be :a' very critical item, as you can see, from'our <br />own regional administrator of the EPA, who has taken it upon himself to <br />try to'defeat the will of the people of Denver by going to Washington <br />and saying, "I 'don't personally like the Foothills Project."- <br /> <br />This is something we have never experienced in our history. : It is <br />something we should do something about. We have the salinity suit now. <br />The Governor -is concerned about it, along with the Governors of the <br />other Colorado Basin :states. The Environmental Defense Fund is appar- <br />ently answerable to no one, but it seeks 'to supplant the governments of <br />the various states. <br /> <br />'-34- <br />
