This bill is gaining momentum
with increased sponsorship. The current Energy Policy Act states that manufacturers will only
supply 1.6 gallon toilets, 2,5 gpm showerheads and faucets. The manufacturers have already
retooled their industry to support the current requirements in the Energy Policy Act. These items are
now on the market.

Status

There has been a call for letters opposing the current amendment to the Energy Policy Act by
several groups, including the government committee of the American Water Works Association.
The State of New Mexico has replied to their Senator opposing Representative Kollenberg's bill.
Denver Water has written a letter opposing H.R. 859.

Many cities in Colorado have passed ordinances requiring water use efficiency plumbing. State
agencies must consider low water use plumbing requirements when renovating or constructing new
buildings. The State of Colorado has not passed a bill requiring 1.6 gallon toilets, low-flow
showerheads or faucets.

The issue we are presented with is supporting or opposing this bill based on whether or not the
federal government should specify plumbing standards, or take no position.

.

I will keep the Board informed of the progress of Representative Kollenberg's bill as it progresses in
the House and/or Senate. I have attached a list of sponsors of the bill as of February 17, 1998. If
you need additional information, please let me know.
