Agenda Item 16d, November 22-23, 1999 Board Meeting - Severance Tax
Trust Fund Statewide Water Planning Account

The CWCB may annually request up to five-percent of the funds in the
Operational Account of the Severance Tax Trust Fund for water planning and other
activities. In Fiscal Year 2000-2001, we are requesting $585,000 for a variety of projects
(see attached). Our requests have been reviewed by the State Minerals, Energy and
Geology Policy Advisory Board and forwarded to the Governor and the General
Assembly as a part the DNR's annual budget request.

Unless the money is appropriated into an account that authorizes the funds to be
carried over for use in subsequent fiscal years, the money must be expended within the
fiscal year in which it is appropriated. This has created difficulty because some grantees
and projects have not been able to complete a project within the fiscal year.

We recommend that you approve the creation of a new Severance Tax Trust
Fund Statewide Water Planning Account and authorize us to work with the
Executive Director's Office and the General Assembly. The new account would be
designed to allow funds to be carried over for use in more than one year.

Stricter intemal severance tax project management to ensure funds is distributed
as soon as possible is accompanying this effort.

We will present the specific legislative language we are proposing for your review
in January.
