<br />. <br /> <br />. <br /> <br />. <br /> <br />CARLSON, HAMMOND & PADDOCK, L.L.C. <br /> <br />Board Members, CWCB <br />May 11,1998 <br />Page 2 <br /> <br />· The proposed flow rates for the instream flow reach are 19 d.s. for May 15 - <br />August 14; 9 d.s. for August 15 - November 30; and 7 c.f.s. for December <br />l-May 14. <br /> <br />· The proposed instream flow reach runs through private property, part of <br />which has been owned by Pueblo since 1951. The property has been used <br />as irrigated grazing land for more than 100 years and always has been closed <br />to public access. <br /> <br />· Pueblo owns the Lucas Ditch, which is decreed for 15 c.f.s. with an <br />appropriation date of November 30, 1879. The Lucas Ditch diverts water <br />from the mainstem of Tennessee Creek just above the upper terminus of the <br />proposed instream flow reach. The Lucas Ditch is used for irrigation purposes <br />on property owned by Pueblo. <br /> <br />. <br /> <br />Pueblo also owns transmountain ditches that import water into Tennessee Park <br />from the Colorado River basin. Pueblo owns the Ewing Ditch, decreed for <br />18.5 d.s. with an appropriation date of June 1, 1906; the Wurtz Ditch, <br />decreed for 85 c.f.s. with an appropriation date of June 8, 1929; and the <br />Wurtz Extension Ditch, decreed for 100 d.s. with an appropriation date of <br />October 26, 1953. <br /> <br />· At a minimum, transmountain water from the Ewing Ditch probably was <br />included in the CWCB's determination of water availability for the proposed <br />instream flow reach. <br /> <br />Background on Pueblo's Tennessee Creek Reservoir <br /> <br />· Pueblo appropriated its Tennessee Creek Reservoir water storage rights on <br />September 6, 1949. On that date, the Trustees of the Pueblo Board of Water <br />Works (the predecessor in interest to the current Board of Water Works) <br />adopted a resolution authorizing its consulting engineer to prepare a survey <br />for a reservoir on Tennessee Creek in Tennessee Park. <br /> <br />· On April 10, 1951, Pueblo voters approved general obligation bonds in the <br />amount of $800,000, for stated purposes, including the purchase of the <br />Tennessee Creek Reservoir dam site. <br />
