Final Notice - Intent to Appropriate Instream Flow Water Rights

The Colorado Water Conservation Board (CWCB) intends to appropriate instream flow water rights on
the attached list of Instream Flow (ISF) Recommendations in Water Division 4 (Uncompahgre River
Drainage) at its next meeting in Denver, Colorado, in the morning on November 23, 1998. CWCB
meetings begin each day at 8:00 a.m.

Staff is recommending the CWCB determine: (a) a natural environment does exist on each stream; (b)
water is available for appropriation; (c) the natural environment will be preserved to a reasonable degree
by the water available for the recommended appropriations; (d) there is a natural environment that can be
preserved to a reasonable degree with the recommended in stream flow water right, if granted; and (e)
such natural environment can exist without material injury to other existing water rights.

Instream Flow Recommendations Investigations Files (Investigations Files) are available for public
review and staff is available to answer questions and note concerns at the above address and at the Board
meeting. Instream Flow Summary Reports are also available for review in the local area of concern at the
Division 4 Water Resources Office, 1540 East Niagara, Montrose, (970)-249-6622. Additional
information regarding the current status of any instream flow recommendation can be found on the
CWCB's Internet Web Pages at the following address:

Should you wish to comment on any of the attached ISF Recommendations, you may do so by writing the
Board's staff at the address given above or by email [e-mail] should be noted
that while your appearance at the Board meeting is welcome, such an appearance is not necessary for your
concerns to be recognized. The staff will take your comments into account and, if you so request, will
present them to the Board in your absence.

To insure adequate notification of all interested parties, we are requesting that you share this notice with
any groups or individuals who you feel would have an interest in the attached ISF Recommendations. If
you are not currently on the Board's Instream Flow Notification List and you would like to be notified of
any future Board action regarding ISF Recommendations please contact the Board at the above address
given above.

The State's Instream Flow and Natural Lake Level Program is administered by the Colorado Water
Conservation Board pursuant to section 37-92-102(3), Colorado Revised Statutes (1997) and the ISF
Rules and Procedures adopted by the Board (copies available by request at the address above).
