Contestant, Eldred Colorado Family Limited Partnership (hereinafter "Eldred"). tiled <br />a Notice to Contest the [nstream Flow Appropriation for Horsefly Creek (hereinafter "[SF") on <br />March 31, 2005. <br /> <br />2. Contestant is the OWner of property and vested absolute and conditional water rights. <br />as described on Exhibit A. ",;thin the Horsefly Creek basin. These water rights are senior to the <br />proposed [SF water right and are located approximately 10 miles upstream. <br /> <br />3. The CWCB stipulates that use of Eldred's absolute water rights consistent with their <br />historic and decreed uses shall not cause injury to the [SF sought by CWCB. <br /> <br />4. Eldred engaged the services of Minion Hydrologic to obtain accurate diversion and <br />place of use locations for Eldred's absolute water rights to support an application to correct the <br />dccrccd points of diversion. places of use or storage locations to conform to the historic use. <br /> <br />5. The eWCB agrees not to oppose any applications tiled by Eldred to COrrcct the points <br />of diversion. places of use or storage locations to conlorm the decrees to historic practices and <br />actual field locations lor the Eldred absolute .....ater rights. <br /> <br />6. Further. Eldred is diligently pursuing development of the Finch Reservoir and Finch <br />Reservoir Feeder Ditch conditional .....ater righIS.
