The McClung share of the average consumptively used Church Ditch water was <br />determined in Case No. 82 CW 177 to be 27.73 acre feet per year. The increased use pursuant to <br />this'amendment of the plan for augmentation wi.lI thus still leave 13.62 acre feet per year of <br />consumptive use from the applicants' Church Ditcb water rights for use as replacement water for <br />the nearby 226.58 (now 150) acres ofland owned by.the applicants. Any such use on tbe <br />remaining acreage to be developed in the future v:i~l!equire a sep~ate decree. <br /> <br />12 Peak monthly demand during the summer months (June, July, August) bas been <br />calculated to be 7.42 acre feet per month. Peak monthly demand in winter months (the remaining <br />9 months of the year) has been calculated to be 6.91 acre feet per month. See Appendix 1, <br />entitled "Calculations for Consumptive Use on a Monthly Basis," attached to and made a part of <br />this Report and Ruling. For purposes of the calculation, a conservative estimate that all out-of- <br />doors demand would occur during the three summer months was made. In actuali.ty, out-of-doors <br />usage may occur during months other than June, July and August. Spreading out-of-doors <br />demand out further would decrease the effect on the stream. To accommodate this fact, the <br />summer month calculations contained in Appendix I shall be serve as peak monthly limitations . <br />for the entire period of the summer instream flow right held by the CWCB. See paragraph 19, <br />infra . <br /> <br />13. The effect of instantaneous stream depletion due to pumping of the wells is <br />calculated to be 0.115 cfs during 9 winter months ofthe year, and 0.123 cfs during three summer <br />months of the year (June, July, August). See Appendix 1. Actual stream depletion will be less <br />than the calculated amounts because individual wells will be intermittently pumping, eliminating <br />effects continuous use might cause. Also, the wells arc spread out over a largc area, minimizing <br />any depletion effect at a specific location along the river. <br /> <br />CONCLUSIONS OF LAW <br /> <br />14. As set forth above, the applicant's proposed changes to the plan ofaugroentatioll <br />decreed in Case No. 82 CW 177 may be implemented without injuriously affecting the vested or <br />decreed conditional water rights of other water users, and the application should be granted. <br /> <br />15. The change to the plan of augmentation and the Applicant's Church Ditch water <br />rights are ones contemplated by law, and if administered in accordance with this decree will <br />ensure that the use of the Applicant's wells for water supply to the subdivision will not <br />injuriously affect the vested or decreed conditional water rights of other water users. <br /> <br />16. Matters previously determined in Case No. 82 CW 177 are considered res judicata, <br />including the amount of water historically used by and attributable to Applicant's share of the <br /> <br />. <br /> <br />5 <br />
