reached, those other parties ought to be con-
sulted.

I

~fuen this matter came up, gentlemen, it
seemed to me that there was a possibility of
setting a dangerous precedent here. We had
gone through, I think, many weeks and months,
(I know in the early days I'd gone through
months), of negotiation on this Fryingpan-
Arkansas. Then afterwards a new set of operat-
ing principles were negotiated and arrived at.
It seemed to me that that was the framework under
which this Fryingpan-Ark ought to be operated.
We've acquired the reputation in the past, I
think maybe of being somewhat, or taken the atti-
tude, of dogs in the mangers over there: but
believe me, I believe that we are all recognizing
the fact that there is a limit of the amount of
water in the Colorado River system and there is
a limit to the development. And in this ,particu-
lar instance that I am now coming to, the Metro-
politan Case, as you know, awarded to the Metro-
politan Water Users Associ~tion and the City of
Arvada, or rather Aurora and Colorado Springs a
certain amount of water. In that same decree,
however, there were certain rights awarded to the
Colorado River water Conservation District. Those
are junior rights. Now to the extent ,that more
water can be taken or the conditional decree for
a greater amount can be perfected, by reason of
the coordination of the operating principles
adopted in connection with the authorization of
the Fryingpan-Ark and the use of additional
waters from Homestake Creek in the upper reaches
of the Eagle River, we think we are affected.

This resolution before you purports to set
up what we believe are certain facts which are
borne out by the records and then we make certain
deductions. I know from your attitude at these
prior meetings and I've been before this Board in
times past so I claim to be a little judge of
human nature maybe, that there are about three
courses you can take at the present time. You
can reject the resolution: you could approve it
