<br />time before the proposed contract had been <br />reached, those other parties ought to be con- <br />sulted. <br /> <br />I <br /> <br />~fuen this matter came up, gentlemen, it <br />seemed to me that there was a possibility of <br />setting a dangerous precedent here. We had <br />gone through, I think, many weeks and months, <br />(I know in the early days I'd gone through <br />months), of negotiation on this Fryingpan- <br />Arkansas. Then afterwards a new set of operat- <br />ing principles were negotiated and arrived at. <br />It seemed to me that that was the framework under <br />which this Fryingpan-Ark ought to be operated. <br />We've acquired the reputation in the past, I <br />think maybe of being somewhat, or taken the atti- <br />tude, of dogs in the mangers over there: but <br />believe me, I believe that we are all recognizing <br />the fact that there is a limit of the amount of <br />water in the Colorado River system and there is <br />a limit to the development. And in this ,particu- <br />lar instance that I am now coming to, the Metro- <br />politan Case, as you know, awarded to the Metro- <br />politan Water Users Associ~tion and the City of <br />Arvada, or rather Aurora and Colorado Springs a <br />certain amount of water. In that same decree, <br />however, there were certain rights awarded to the <br />Colorado River water Conservation District. Those <br />are junior rights. Now to the extent ,that more <br />water can be taken or the conditional decree for <br />a greater amount can be perfected, by reason of <br />the coordination of the operating principles <br />adopted in connection with the authorization of <br />the Fryingpan-Ark and the use of additional <br />waters from Homestake Creek in the upper reaches <br />of the Eagle River, we think we are affected. <br /> <br />I <br /> <br />This resolution before you purports to set <br />up what we believe are certain facts which are <br />borne out by the records and then we make certain <br />deductions. I know from your attitude at these <br />prior meetings and I've been before this Board in <br />times past so I claim to be a little judge of <br />human nature maybe, that there are about three <br />courses you can take at the present time. You <br />can reject the resolution: you could approve it <br />
