Aoolication Summary

This is an application for a change of water rights, plan for augmentation and exchange within
the Clear Creek watershed in Jefferson, Clear Creek and Park Counties near Golden (see attached
map). In this application, the Applicant proposes numerous changes of water rights and the
augmentation of numerous junior water rights.

While the majority of the proposed changes and a significant portion of the proposed
augmentation plan do not adversely effect the Board's instream flow water rights, there are two
aspects of the application which may injure the Board's water rights. First, the Applicant
proposes to change the use of the Loch Lomond Group of Reservoirs and the Fall River Group of
Reservoirs from irrigation and domestic to include municipal, industrial, exchange and
augmentation uses. Second, the Applicant propOses to augment out-of-priority depletions
associated with the Frost and Waldorf Reservoirs with various surface and ground water rights
located downstream on Clear Creek and/or the South Platte River. Each reservoir is decreed for
400 acre-feet with an October 28, 1965 appropriation date.

Potential for Iniury

The Applicants' proposed change of water rights may deplete the Board's instream flow
appropriations on the Fall River. In addition, the proposed plan for augmentation may not replace
depletions to the Board's instream flow water rights to Leavenworth Creek in the same time,
amount or location as they historically occurred.
