<br />Consent Agenda Item 4-3.b. <br />Case No. 1-99CW228; Mueller . <br /> <br />Application Summary <br /> <br />This is an application for a Plan for Augmentation and storage water rights on Cherry Creek in <br />Douglas County near the toWIi of Castle Rock (see attached map). The Applicant is proposing to <br />augment the depletions associated with Mueller Pond using the Cleona Ditch, the Cleona I" <br />Enlargement, the John Jones Ditch, the Pioneer Ditch, the Pioneer Ditch 1" Enlargement, the Welsh <br />Ditch, the City of Aurora Metro wastewater outfall, non-tributary ground water, the Necessity Ditch <br />and/or the Conehay Ditch. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instream flow right on Cherry Creek for 1.5 cfs (March 1 to April 30), 3.5 cfs <br />(May 1 to June 15 and Nov. 1 to Feb. 29) and 1.5 cfs (June 16 to Oct. 31) with an appropriation <br />date of December 22,1994, which may be injured by this application. <br /> <br />Potential for Iniury <br /> <br />The Applicants' proposed plan for augmentation may not replace depletions to the Board's instream <br />flow water rights on Cherry Creek in the same time, amount and location as they have historically <br />occurred. <br /> <br />. <br /> <br />Other Objectors <br /> <br />Other objectors in this case include the City of Thornton and the Parker Water and Sanitation <br />District. <br /> <br />. <br /> <br />L:\ WCTRANS\SEcaCase Files\199CW228 _ mem.doc <br />
