,

Consent Agenda Item 4-3.a.
Case No. 1-99CWI99; Centennial Water and Sanitation District, et al. .

Application Summary

This is an application for a plan for augmentation and change of water rights on Tarryall Creek near
the town of Como in Park County (see attached map). The Applicant seeks to quantify the historic
consumptive use associated with the "Cline Rights" diverted at the following structures: the Dunbar
Ditch, the Anderson and Brewer Ditch, the Dunbar No. I Ditch, the Montag and Truax Ditch, the
Peabody No.3 Ditch and the Park Gulch Ditch. Once quantified, the Applicant requests that these
consumptive use credits be diverted at the following alternate points of diversion: the South Platte
Alluvial Well Field No.2, Chatfield Reservoir, South Platte Reservoir, McLellan Reservoir,
Montag and Truax Ditch,' Peabody No.3 Ditch, Steve Cline Reservoir No. 1-3, Peabody Ditch
Infiltration Canal, Strontia Springs Reservoir, Tarryall Reservoir, Anderson and Brewer Ditch and
Denver Basin aquifers underlying Highlands Ranch.

The Applicant also plans to divert a portion of the historic consumptive use credits at other
structures in an attempt to duplicate the historic delayed return flows to prevent injury to the
CWCB's instream flow right. The Applicant proposes to augment the out-of-priority depletions
associated with the South Platte Alluvial Well Field No.2 using various water rights owned by the
Applicant, including the Cline Rights described in this application.

CWCB Appropriations

.

The Board has appropriated the following instream flow water rights that could be injured by this
application.

Case No.
1-76W8229
1-77W8729
1-77W8730

Stream
Tarryall Creek
T arryall Creek
T arryall Creek

Amount (efs)
7
14
20

Appropriation Date
01114/1976
11/15/1977
11115/1977

Potential for Iniury

The Applicant's proposed change in place, type and time of use of water rights may injure the
Board's instream flow water rights on Tarryall Creek.

Other Objectors

Other objectors in this case include the City of Englewood, City of Aurora, Upper South Platte
Water Conservancy District, Frieda Wahl Trust, City and County of Denver, Center of Colorado
Water Conservancy District, City of Thornton, Colorado Division of Wildlife and the State and
Division Engineers.

.

L:\ WCTRANS\SECaCase Files\ 199CWI99 _ mem.doc
