Application Summary

This is an application for a plan for augmentation on the Blue River and Spruce Creek in Grand
and Summit County near the town of Kremmling (see attached map). In this application, the
Applicant proposes to amend an augmentation plan decreed in case no. 5-93CW293, a case in
which the CWCB has terms and conditions protecting its instream flow water rights. The
Applicant proposes some additional structures/diversions as well as removing some that were in
the original augmentation plan.

The Applicant proposes to augment depletions associated with the Eagle Pass Ranch Spring Nos.
I & 2, the Blue Valley Ranch Well No.2, the Blue Valley Ranch Working Headquarters Well
No. I, the Blue Valley Ranch Irrigation Sump Nos. Nos. 1 & 2 and the Blue Valley Ranch North
Spruce Creek Diversion. Releases from Green Mountain Reservoir will provide the
augmentation of out-of-priority diversions associated with these structures.

Potential for Iniury

The Applicant's proposed plan for augmentation may not replace depletions to the Board's instream
flow water rights on the Blue River and/or Spruce Creek in the same time, amount and location
which they historically occurred.

Other Obiectors

Engineers.
