The subdivision is located approximately five miles
southeast of Basalt in the Little Elk Creek and Capitol Creek
drainages. The CWCB has an instream flow decree on Capitol Creek
for 10 cfs with an appropriation date of January 14, 1976.

Applicant's Proposal

The applicant proposes to drill four'wells within the 150
acre Little Elk Creek Village subdivision. The four wells would
become part of a central water system which would serve all 75
lots within the subdivision. The applicant plans to change the
use of water from irrigation to domestic use and augment the well
depletions with 2.28 acre-feet of consumptive use from the Boram
and White Ditch, thus alleviating any potential injury to the
Capitol Creek instream flow during the irrigation season.

During the non-irrigation season the applicant proposes to
release 3.2 acre-feet of water purchased from the Basalt Water
Conservancy District out of Ruedi Reservoir. Such a release would
protect water rights downstream of Basalt but would not alleviate
the injury to instream flow rights on Capitol Creek.

715
lit/crk

.

APPENDIX 0
