<br />. <br /> <br />. <br /> <br />. <br /> <br />BEFORE THE COLORADO WATER CONSERVATION BOARD <br /> <br />SECOND PRE HEARING CONFERENCE ORDER <br /> <br />IN THE MATTER OF FOURMILE CREEK AND OIL CREEK PROPOSED INSTREAM <br />FLOW APPROPRIATIONS <br /> <br />1. A second prehearing conference for the contested proposed instream flow appropriations <br />on Fourmile Creek and Oil Creek was held on September 12 at 1:00 P,M, in Room 310 of <br />the State Services Building, 1525 Sherman Street, Denver, Colorado. All Parties where in <br />attendance except Pisgah Reservoir & Ditch Company and Catlin Canal Company, which <br />had submitted a letter earlier stating that it would not be presenting evidence at the <br />hearing. <br /> <br />II, <br /> <br />CWCB Staff and DOW have informed the Hearing Officer that some of the Parties have <br />reached an agreement and that the City of Cripple Creek and the Cripple Creek and <br />Victor Gold Mining Company will withdraw their Notice to Contest Staffs instream flow <br />recommendation, Pisgah Reservoir & Ditch Company and Catlin Canal Company is not <br />withdrawing their Notice to Contest, but will present an argument on law and policy to <br />the Board. Therefore, the procedures described in the first Prehearing Order are no <br />longer necessary. <br /> <br />III. <br /> <br />CWCB Staff shall mail their final recommendations for instream flows on Fourmile <br />Creek and Oil Creek to the Board members, all Parties, and Contested Hearing <br />Participants on or before September 18, 2000, <br /> <br />N, Hearing: The Colorado Water Conservation Board ("Board") will hold a hearing <br />beginning at 8:00 A.M, on September 26 at the St. Cloud Hotel, Canon City, Colorado, <br />At that time the Board will receive and consider Final Staff Recommendations and <br />Staffs reports, the Parties' stipulations, arguments by Pisgah Reservoir & Ditch <br />Company and Catlin Canal Company and responses by the Parties, and any public <br />comment.
