W1295-77, W1323-77, W1333-77, W1340-77, <br />W1346-77, W1347-77, Water Division 6 <br /> <br />The CWCB staff requests the Board's approval to withdraw <br />several applications which were filed on behalf of the Board for <br />instream flows in Water Division 6. This recommendation is the <br />result of staff review of additional data submitted by the <br />Division Engineer, Wes Signs, after these applications had <br />already been filed with the court. The Division of wildlife was <br />also consulted in this review. <br /> <br />The underlying reason for the staff recommendation to <br />withdraw the Board's applications in these cases is the lack of <br />available water to sustain the natural environment to a <br />reasonable degree. <br /> <br />The cases are as follows: <br /> <br />W1295-77 - Milk Creek <br /> <br />This appropriation was approved by the Board on November 15, <br />1977. The upstream point of the appropriation is from the <br />bridge on Yellow Jacket Pass Road to the bridge on Colorado <br />Highway 13 as the downstream terminus, this being a distance <br />of approximately 16 miles. The flow requested in the <br />original application was 8 cfs. It was determined that much <br />of ,the natural flow disaooears when the stream crosses a <br />porous geologic formatio~'in Section 36, Township 3N, Range <br />92W. <br /> <br />W1323-77 - North Fork Middle Creek <br /> <br />This appropriation, which was approved by the Board on <br />September 23, 1977, is from the headwaters to the confluence <br />of Middle Creek, a distance of approximately 4 miles. The <br />appropriation was for 1 cfs. It was determined that there <br />was no viable fishery and no flow much of the year. <br />
