<br />2. The variance is the minimum necessary, considering the flood hazard, to afford <br />relief; and <br />3. Failure to grant the variance would result in exceptional hardship to the community <br />and that the hardship is not the community's own making; and <br />4. The granting of a variance will not result in increased vulnerability to flood losses, <br />additional threats to public safety, extraordinary public expense, create nuisances, <br />cause fraud or victimization of the public, hide information of significant interest to <br />the public or conflict with existing local laws or regulations. <br /> <br />Rule 15. Incorporation bv Reference: The Statement of Basis and Purpose for the <br />Adoption of these Floodplain Designation and Approval Rules is incorporated by <br />reference as part of these rules. 44 CFR 60.3( c)(1 0) and 44CFR 60.3( d) are incorporated <br />herein by reference. (WE NEED THE APPROPRIATE AGENCY. DATE, TITLE, OR CITATION <br />OF THE MATERIAL. WE MUST ALSO INCLUDE IN ANY RULE WHICH INCORPORATES <br />MATERIAL BY REFERENCE THE TITLE AND ADDRESS OF AN EMPLOYEE OF THE AGENCY <br />WHO WILL PROVIDE INFORMATION REGARDING HOW THE INCORPORA TED MATERIAL <br />MAYBE OBTAINED OR EXAMINED AND A STATEMENT INDICA TING THAT ANY MATERIAL <br />THAT HAS BEEN INCORPORATED BY REFERENCE IN THE RULE MAYBE EXAMINED AT ANY <br />STATE PUBLICATIONS DEPOSITORY LIBRARY. <br /> <br />Rule 16. Severabilitv: If any portion of these Floodplain Designation and Approval Rules is found <br />to be invalid, the remaining portion ofthe rules shall remain in force and in effect. <br /> <br />Rule 17. Recommended Activities for Rel!ulatorv Floodplains: <br />The following list contains floodplain management activities and actions suggested by the cWCB to <br />increase a community's overall level of flood protection. Communities and other authorized <br />government entities may: <br />A. Adopt local standards above and beyond the FEMA and CWCB minimum requirements. <br />B. Develop a Flood Response Plan that identifies responsibilities/actions before, during and after a <br />flood event. <br />C. Enroll in FEMA's National Flood Insurance Program (NFIP) and possibly FEMA's <br />Community Rating System (CRS) Program. <br />D. Develop an early warning flood detection system (flood warning system) using available <br />technologies such as automated precipitation and stream flow gages linked to an appropriate <br />notification system. <br />E. Coordinate with lenders, insurance agents, real estate agents, and developers to prepare and <br />discuss educational tools based on state and federal requirements. <br />F. Promote wise floodplain development and support effective structural and non-structural flood <br />mitigation projects. <br />G. Conduct floodplain studies in areas of foreseeable development that do not currently have <br />detailed floodplain studies. <br />H. Maintain an electronic or paper library oflocal flood related data. <br />L Develop a flood risk outreach program and notify flood prone residents annually of flood <br />hazards and the need for flood insurance. <br />J. Encourage elevation offloodprone structures and floodproofing of structures in the floodplains. <br />K. Utilize available state/federal mitigation and preparedness funds. <br />L. Require certified floodplain managers to review proposed land developments. <br /> <br />20 <br />
