Status ofInstream Flow ADDroDriations Filed with the Water Court Prior to 1998

As of January 1998, the CWCB had 43 instream flow (ISF) appropriations which had been filed
with the water court but had not yet been decreed. Of these 43 ISF appropriations, 41 were
opposed by one or more objectors, totaling 107 Statements of Opposition (SOP). The following
Table shows the number of segments opposed, the year the appropriations were filed, the Water
Division and County(ies) where the appropriations are located, the number of SOP's filed, the
number of SOP's resolved in 1998 and the number of SOP's and ISF segments remaining.

1998 Instream Flow ADDroDriations

The CWCB appropriated 49 additional instream flow segments totaling approximately 267 miles
of stream in 1998. The following table shows the number of segments filed, the Water Division
and County(ies) where the appropriations were filed and the total stream miles protected:

These 49 water court applications were published in the December 1998 Water Court Resume. As
of March 22, 1999, staff has received 29 statements of opposition relating to 16 different instream
flow segments. Staffwill continue to update the Board regarding the status of these 49 in stream .
