conditions shall include any necessary and/or desirable limitations upon
the time, place or type of use of the water made available through the
water bank, or other terms and conditions as deemed necessary to
prevent injury to vested water rights.
Upon a favorable determination by the water bank and the State and
Division Engineers of the viability of the agreement, the seller and buyer
may finalize the agreement as necessary (e.g. payment for use of the
deposited water).
The water bank shall establish and charge necessary fees to cover
administration costs incurred during the operation of the bank.

Quantification Procedures for Water to be Released from the Bank.

A.

Presumptive Factors. The following table indicates presumptive values
for stored water historically applied to ditch service areas as winter water,
Article II water and/or pursuant to appropriative storage rights when
deposited in the water bank. No presumptive factors are proposed for
use in connection with waters associated with the Colorado Canal, Lake
Henry, or Lake Merideth for which quantification procedures have been
established by decrees of the Water Court. Only that portion of each unit
of deposited water determined as consummable through application of
the appropriate consumptive use factor from the table shall be deliverable
less any amounts deducted by the Division Engineer for evaporation and
transit loss. That portion identifiable as canal and lateral loss is to be
dedicated to use of other water users within the ditch service area. The
remaining tailwater and deep percolation components shall be released to
the river by the Division Engineer to maintain historic return flow patterns
within the succeeding 12 months.
