<br />Rule 4. <br /> <br />B. <br /> <br />by the Arkansas River Compact Administration on April 24, 1980 <br />(as amended) and accounted as "winter stored water" under <br />"Agreement B" dated Novertlber 1984. <br />3. "Beneficial consumptive use" means the amount of water actuaily <br />consumed in applying the w~ter right to its legal use. <br />4. "Deposit account" means thl'! amount of stored water a person or <br />entity places in the water blink. <br />5. "Interruptible supply" means the temporary cessation of the <br />historic use of stored water and temporarily using the water at <br />another location, and/or for a different use, and/or at a different <br />time. ' <br />6. "Return flow(s) means the ~mount of the water that is not <br />consumed and returns to thl'! stream following a legal use of a <br />given amount of water. I <br />7. "Transit loss" means the aniount of water deducted by the Division <br />Engineer in the delivery of water from one point to another due to <br />stream and environmental conditions. <br />8. "Water bank" means the Pilpt Arkansas River Water Bank, which <br />is a program authorized by Ihe Colorado General Assembly to <br />receive and safeguard lega'ly stored water for exchange, lease or <br />loans and to facilitate such jransactions. <br />9. "Water banking" means te~porarily placing legally stored water <br />into an account within the \II1ater Bank whereby that water is then <br />leased, loaned, or exchanged to another user. <br />10. "Winter water" means water stored using the Winter Water <br />Storage Program as described in Case No. 84CW179, Water <br />Division 2 <br />Any term used in these Pilot Wate~ Bank Rules that is defined in 37-90- <br />103 or 37-92-103, C.RS. shall ha~e the same meaning given therein. <br />Any term used in these Pilot Wate~ Bank Rules not defined herein that is <br />defined in other Rules and Regulations of the State Engineer shail have <br />the same meaning given therein. I <br /> <br />Limitations on the Pilot Water Bimk. <br /> <br />C. <br /> <br />A. <br /> <br />Nothing in these rules shail be construed to authorize any lease, <br />exchange, or loan of water below ~ohn Martin Reservoir to points of <br />diversion or storage above John ~artin Reservoir without the approval of <br />the Arkansas River Compact Admi:nistration. <br />No transfer of water from the banklto instream flow uses as provided in <br />section 37-92-102(3), C.RS. (2001) is allowed except where such <br />transfer, lease, loan, exchange or $ale is to the Colorado Water <br />Conservation Board. . <br />The water bank shall not be used to export water out of state. <br />The water bank shall not own, buy! or sell water, but shall facilitate the <br />lease, loan, or exchange of water between water users. <br />The water bank shall not operate ip a manner so as to increase water <br />diverted from another water division as set forth in Section 37-92-201, <br />, <br />C.RS.
