We may have to have some- <br />thing added to what you folks might be considering on that particular <br />stream. <br /> <br />Mr. Moses: Well. this again goes back to what we have been saying. <br />This cannot affect previous older rights. What the United States is <br />seeking are rights as of the time of the establishment of the forests <br />and as such they would be rights which would be senior to any right <br />which the water board can get. If they get a bigger decree. it is a <br />right that has to be protected just like a senior irrigation right. <br /> <br />Mr. Stapleton: All right. this gentleman in front here. <br /> <br />Mr. Currier: I am Ed Currier and an engineer for the Colorado River <br />Water Conservation District. I think what I have to say doesn't really <br />affect your motion as you are getting ready to vote on it. All I <br />wanted to do is perhaps clarify a little bit why our district did ask <br />for a deferral on the streams in our division. It relates to some of <br />the various things that you have been discussing regarding what the <br />relationship might be to existing rights and possible transfer of either <br />of point of diversion or change of use of such rights. I think perhaps <br />you helped clarify some of my lack of knowledge anyway. But in par- <br />ticular on the Crystal River it appeared that probably the flows were <br />based on the gaged records which happened to be near the upper end of <br />the. reach of Avalanche Creek and the lower portions of that down toward <br />the confluence with the Roaring Fork River. This stream historically <br />in dry years has been almost completely dried up. I think in 1973 <br />perhaps the existing right very nearly utilized all that stream. There- <br />fore, we wanted time to satisfy ourselves a little bit as to the <br />situation where you had indicated during the months of August and <br />September minimum flows of 100 second feet which would certainly be <br />reasonable at Avalanche Creek, but we wondered as to how reasonable <br />they might be farther down where the diversions take place. We still <br />appreciate your deferral of this matter. I just wanted to make a <br />clarification. Thank you. sir. <br /> <br />Thank you very much.
