<br />Rulemakine. <br /> <br />With regard to the rulemaking, it is important that the Board promulgate rules as. <br />soon as possible so that it can meet the statutory de~dlines set forth in Senate Bill 216, <br />should any applications be filed in the near future, ;Thus, we have written an initial draft <br />'ofrules, which is attached. The purpose of this initial draft is to solicit comments from <br />the Board and the public; it is not part of the formal rule-making process, Rather this is <br />just the first step towards developing rules that the Eoard could publish in August as part <br />of its notice ofrulemaking, It is the Staff's intention to obtain as much public input for <br />these rules, as possible, before initiating the forma) public rulemaking, If there is more <br />public input and support for the rules when the rul~s are published in August, then the <br />rulemaking process will be more efficient. Consequently, the Staff proposes to discuss <br />this issue at several locations across Colorado, at different times of day, in an attempt to <br />receive comments from different people who represent a variety of interests. <br /> <br /> <br />" <br /> <br /> <br />. <br /> <br />Staff Recommendation <br /> <br />The Staff recommends that the Board authorize Staff to: I) distribute the initial <br />draft ofthe rules for public comment and review; hnd, 2) proceed according to the <br />following schedule: <br /> <br />May 17 <br />May 21 <br /> <br />May 25 <br />Week ofJuue 25-29 <br />July 1 <br />July 13 <br /> <br />July 23 <br />August 10 <br />September 24-25 <br />Early October <br /> <br />October 15 <br />November 10 <br />November 30 <br /> <br />Deliver initial draft of Recreational In-Channel Diversion <br />(RICO) Rules to the Board <br />Obtain Board comments regarding the initial draft <br />(Breckenridge) , <br />Mail initial draft offRICD Rules to the Board's mailing list <br />Public meetings (Glenwood Springs and Denver) <br />Final deadline for ri:ceipt of comments on the initial draft <br />Second draft ofRICD Rules completed and distributed to <br />Board and the public <br />Informal discussio1). of Second Draft (Montrose) <br />Formal Notice of rule-making published in CCR <br />Formal rule-makin~ hearing (Cortez) <br />Attorney General & Legislative Conncil review within 20 <br />days of adoption of the rules. <br />Final rules sent to $ecretary of State by October 15th <br />Publication ofFiUlll rules in CCR November lOth <br />Rules become effe~tive <br /> <br />. <br /> <br />. <br /> <br />2 <br />
