Rulemakine.

With regard to the rulemaking, it is important that the Board promulgate rules as.
soon as possible so that it can meet the statutory de~dlines set forth in Senate Bill 216,
should any applications be filed in the near future, ;Thus, we have written an initial draft
'ofrules, which is attached. The purpose of this initial draft is to solicit comments from
the Board and the public; it is not part of the formal rule-making process, Rather this is
just the first step towards developing rules that the Eoard could publish in August as part
of its notice ofrulemaking, It is the Staff's intention to obtain as much public input for
these rules, as possible, before initiating the forma) public rulemaking, If there is more
public input and support for the rules when the rul~s are published in August, then the
rulemaking process will be more efficient. Consequently, the Staff proposes to discuss
this issue at several locations across Colorado, at different times of day, in an attempt to
receive comments from different people who represent a variety of interests.

Staff Recommendation

The Staff recommends that the Board authorize Staff to: I) distribute the initial
