<br />e <br /> <br />e <br /> <br />-- <br /> <br />Consent Agenda Item I.b. <br />Case No. 1-00CW060; Mountain Mutual Reservoir Co. <br /> <br />Application Summarv <br /> <br />This is an application for an upstream exchange of 2.0 c.f.s. from Soda Lakes Reservoir Nos. I and <br />2, up North Turkey Creek into storage in Meadowview Reservoir (see the attached map). This 14 <br />mile upstream exchange is similar to the exchange filed by Buffalo Park, which was recently <br />dismissed by Judge Hayes. <br /> <br />CWCB Appropriations <br /> <br />The Board holds the following instream flow rights, which may be injured by this application: <br /> <br />Case No. Stream segment <br />1-94CW250 North Turkey Creek <br /> <br />Appropriation amount (cfs) <br />3 (4/1-7/15) .75 (7/16-3/31) <br /> <br />Appropriation Date <br />11/3/1994 <br /> <br />Potential for Iniury <br /> <br />The Applicant's proposed exchange may injure the Board's instream flow water right on North <br />Turkey Creek. The Applicant should not be able to run the exchange at times when the CWCB's <br />instream flow water right is not met. In addition, the Applicant's diversions at the alternate points <br />of diversion must be limited to the amount of water that is physically and legally available at the <br />original points of diversion. Applicant must install such measuring devices and gages as the <br />Division Engineer deems necessary to administer the proposed exchange. <br /> <br />Other Obiectors <br /> <br />The following parties filed Statements of Opposition: Theodore Zorich; Red Rocks Country Club; <br />Foothills Park and Recreation District; Jefferson County; Buffalo Park Development Co.; and the <br />State Engineer and the Division Engineer for Water Division No. I. <br /> <br />L/BoardmemlJuly2000/consent Agd.
