<br />increased by man-made or natural causes, such as ice jams <br />and bridges or culvert openings being restricted by <br />debris. These regulations do not mply that areas outside <br />the regulated floodplain or land uses permitted within such <br />floodplain will be free from flooding or flood damages or <br />that compliance with these regulations will prevent any <br />or all damages from flooding. These regulations shall not <br />create liability on the part of (local government) or any <br />officer or employee thereof for any flood damages that <br />result from reliance on these regulations or any <br />administrative decision lawfully made thereunder. <br /> <br />4.6 Severabilty - If any section, clause, provision, or portion <br />or portion of these regulations should be found to be <br />unconstitutional or otherwise invalid by a court of <br />competent jurisdiction, the remainder of this regulation <br />shall not be affected thereby and is hereby declared to be <br />necessary for the pUblic health, safety, and welfare. <br /> <br />4.7 Amendments - The regulations, restrictions, and boundaries <br />set forth in these regulations may from time to time be <br />amended, supplemented, changed, or repealed in <br />accordance with the procedures set forth in <br />subsection 2.3.2 of these regulations. <br /> <br />4.8 <br /> <br />Maintaininl FIOodr1ain Management Program <br />Documents or Pub ic Inspection <br /> <br />(Local government) is to maintain for public inspection <br />copies of the community's Floodplain Management <br />Ordinance, Flood Insurance Study and Maps, Letters of <br />Map Amendment, and all records pertaining to floodplain <br />developments. These records include certified lowest <br />floor elevations, floodproofed elevations, certificates <br />of floodproofing methods and floodway encroachment, and <br />records of variance actions. Local government shall <br />provide lowest flood and flood proofing elevations to <br />insurance agents upon request so that National Flood <br />Insurance Policies can be rated correctly. It shall not be <br />the responsibility of local government to determine for <br />lending institutions whether or not a property is located <br />in a Flood Hazard Area or to determine the Flood Insurance <br />Rate Zone of a property for insurance agents. <br /> <br />-21- <br />
