<br />WHEREAS, Ruedi Reservoir, located on the Fryingp:an River above the town of Basalt, was <br /> <br />authorized and constructed as a feature of the Fryingpan-Arkansas Project; and <br /> <br />WHEREAS, the operating principles provide that water stored in the regulatory capacity of <br />Ruedi Reservoir may be sold or leased by the United States to water users in Colorado for any <br />purpose recognized by the laws of the United States; ~nd <br /> <br />WHEREAS, the Supplemental Decree for the Fryipgpan-Arkansas Project entered by the <br />Garfield County District Court, Colorado, in Civil Action 4613 on August 3, 1959, allows water <br />stored in the regulatory capacity of Ruedi Reservoir to be sold or leased by the United States to <br />water users in western Colorado for any purpose rec~gnized by the laws of the United States; and <br /> <br />WHEREAS, the Board is authorized by Section 37-92-102(3), Colorado Revised Statutes. to <br /> <br />acquire by lease from any person, including any governmental entity, such water or interests in <br /> <br />, <br />water as the Board determines may be required for ~nimum streamflows to preserve the natural <br />environment to a reasonable degree and to take whatever action may be needed to ensure such <br />minimum streamflows remain in the river; and <br /> <br />e <br /> <br /> <br />e <br /> <br />WHEREAS, pursuant to Sections 37-92-301 and ~01, Colorado Revised Statutes, the State <br />Engineer's Office is responsible for the administratiqm and distribution of the waters of the State, e <br />, <br />and, pursuant to Section 37-92-102(3), the Board may call upon the State Engineer and Division <br /> <br />3 <br />
