<br />DRAFT -- August 11, 1999 <br /> <br />Working Group on the Endangered Species Act <br />and Indian Water Rights <br /> <br />DRAFT RECOMMENDATIONS <br /> <br />The Working Group has organized its recommendations into three categories. First, <br />there are short statements of broad public policy GOALS, which together represent the <br />ideal context in which all of the Working Group's recommendations should be under- <br />stood. Then there is a list of more particularized OBJECTIVES which state principles <br />on which multi-agency consensus may be possible. Following that list each OBJECTIVE <br />is then re-stated with underlying specific RECOMMENDATIONS for agency actions to <br />implement that OBJECTIVE. RECOMMENDATIONS are each followed by a short <br />explanation of the Working Group's rationale for that RECOMMENDATION. <br /> <br />GOALS: <br /> <br />(1) Implementation of the Endangered Species Act which <br />respects the seniority of Indian water rights. <br /> <br />(2) Implementation of the Endangered Species Act which does <br />not prevent the completion of activities authorized by Congress <br />for the purpose of enabling Tribes to exercise their water <br />rights, while avoiding jeopardy to listed species and adverse <br />modification of critical habitat. <br /> <br />(3) Development of Indian water resources consistent with <br />the promotion of healthy watersheds upon which sensitive species <br />(including candidate, proposed and listed species) depend. <br /> <br />37 <br />
