DRAFT -- August 11, 1999

Working Group on the Endangered Species Act
and Indian Water Rights

DRAFT RECOMMENDATIONS

The Working Group has organized its recommendations into three categories. First,
there are short statements of broad public policy GOALS, which together represent the
ideal context in which all of the Working Group's recommendations should be under-
stood. Then there is a list of more particularized OBJECTIVES which state principles
on which multi-agency consensus may be possible. Following that list each OBJECTIVE
is then re-stated with underlying specific RECOMMENDATIONS for agency actions to
implement that OBJECTIVE. RECOMMENDATIONS are each followed by a short
explanation of the Working Group's rationale for that RECOMMENDATION.

GOALS:

(1) Implementation of the Endangered Species Act which
respects the seniority of Indian water rights.

(2) Implementation of the Endangered Species Act which does
not prevent the completion of activities authorized by Congress
for the purpose of enabling Tribes to exercise their water
rights, while avoiding jeopardy to listed species and adverse
modification of critical habitat.

(3) Development of Indian water resources consistent with
the promotion of healthy watersheds upon which sensitive species
(including candidate, proposed and listed species) depend.

37
