Section 7 consultations should identify options which allow for the future exercise of <br />Indian water rights while avoiding jeopardy to listed species and adverse modification of <br />critical habitat. <br /> <br />3,A. When an agency action is proposed for a federal project in a basin with <br />unexercised Indian water rights, a basin-wide consultation on multiple federal projects <br />should be considered. <br /> <br />3,B, To the maximum extent possible, S 7 consultations should identifY reasonable and <br />prudent alternatives that allow for and those that could impair the future exercise of <br />Indian water rights. <br /> <br />3.C. In consultations on actions by Interior Dept. agencies that could affect the <br />exercise ofIndian water rights, the affected tribe should be a full participant. <br /> <br />3.D, In consultations in river basins having Indian water rights, the FWS should <br />develop staff expertise and utilize the expertise of other federal agencies to insure proper <br />consideration ofIndian water rights. <br /> <br />3.E. When faced with a draft jeopardy opinion on an Indian water project, the <br />participating federal agencies should try to provide resources for reasonable and prudent <br />alternatives involving the acquisition or retirement of other water rights, The agencies <br />should consider involving the state and otber water users in developing a water supply <br />plan to reconcile tribal rights, junior non-Indian rights, and listed species needs. <br /> <br />4. Federal funding should be used to assist tribes to address the environmental impacts <br />ofIndian water development. <br /> <br />4.A. Request funding to enable tribes to study the impacts of Indian water development <br />on listed species and riparian ecosystems. <br /> <br />4.B, Provide technical and financial assistance to tribes to develop conservation plans ' <br />and participate in recovery programs. , <br /> <br />4.C. Authorize financial incentives for tribes to protect riparian ecosystems and <br />recover listed species. <br /> <br />5. Designation of critical habitat should consider the impact on Indian water rights <br />and, iftbere is an adverse impact, areas should be excluded from designation. <br /> <br />5,A. In designating critical habitat, the FWS should consider each affected Indian <br />reservation as one economic unit. <br />
