Request for Expenditure from Litigation Fund for Kansas v. Colorado costs. <br />(Evapotranspiration Issues -Lysimeters, etc.) <br />Tape 1 Track 2 55:45-1:16:00 <br />Action: A motion was made by Harold Miske1 with a second by Eric Wilkinson to approve <br />staff recommendation that the Board authorize an expenditure of up to $750,000 from <br />the litigation fund based on the Attorney General's request that these funds will be <br />used to defend and protect Colorado's allocations of water in interstate streams and <br />rivers. These funds are to be used for the four activities outlined in the Attorney <br />General's letter and detailed in the supporting information provided by the State <br />Engineer, with discretion given to the Board's director to determine the actual funds <br />to be provided for each of the activities. The Board directs staffto monitor expenses <br />via biannual reports that are to be provided to the CWCB by the Attorney General <br />and State Engineer on the use of these funds and the progress on the various studies. <br />The Attorney General will also assist the CWCB in making the necessary reports to <br />the General Assembly pursuant to Section 37-60-l21(2.5)d. Such funding shall be <br />contingent upon the availability of Construction Funds in the Litigation Fund. <br /> <br />Motion was approved 8-0. <br /> <br />\ <br /> <br />12. Conservation and Drought Planning Section - Graywater Pilot Project; Multipurpose . <br />Grant Application <br />Tape 1 Track 2 1:16:00 -1:29:11 <br />Action: A motion was made by Harold Miskel with a second by Greg Hoskin to approve <br />CWCB staff recommendation to participate in and commit up to $50,000 from the <br />AgriculturefMultipurpose Demonstration Grant Fund. <br /> <br />Motion was approved 8-0. <br /> <br />13. Stream and Lake Protection - City of Steamboat Springs, Case No. 6-03CW86 <br />Tape 1 Track 2 1:29:11-1:44:00 <br />Action: A motion was made by Don Schwindt with a second by Harold Miske! to appoint <br />Felicity Hannay as Hearing Officer and Dan McAuliffe as Alternate Hearing Officer <br />for this Recreational In-channel Diversion (RICD) Application Hearing. The motion <br />was approved 8-0. <br /> <br />Action: <br /> <br />A motion was made by Eric Wilkinson with a second by Don Schwindt to add the <br />24th to the May meeting to be May 24 - 27,2004 and move it to Steamboat Springs, <br />Colorado. Also the September meeting will be September 14 - 15, 2004 and will be <br />moved to Alamosa, Colorado, Motion was approved 8-0. (This motion supercedes <br />the previous motion in Agenda Item #1.) <br /> <br />14.
