The Upper Basin Compact specifies <br />that the State of Colorado gives its consent <br />to the construction of diversion works in <br />the State of Colorado in order that New <br />Mexico may utilize its share of the upper <br />Basin Compact water. All waters which New <br />~wxico uses from the San Juan River would <br />be counted as part of its allocation.
