"Water that is diverted by New Mexico
will be counted as part of their IDlare
allocated to them under the Upper Colorado
River Basin Compact, is that right?"

"Yes. The Upper Basin Compact specifies
that the State of Colorado gives its consent
to the construction of diversion works in
the State of Colorado in order that New
Mexico may utilize its share of the upper
Basin Compact water. All waters which New
~wxico uses from the San Juan River would
be counted as part of its allocation. This
includes the San Juan-Chama, the Navajo,
and the Animas-La Plata."

"Has our attorney for the Board reviewed
this?"

"Mr. Moses has reviewed it and he can
speak for himself. It has also been reviewed
by the people in southwest Colorado."

"As the Director has indicated, this has
been a matter of concern and discussion for
at least two years. Although I don't know
that I would have chosen the same verbs that
New Mexico chose, I think the meat of the
cocoanut is in paragraph B of Article I. I
think it accomplishes the purpose and I think
it does so without injury to the rights of
the people in the State of Colorado.

There was some fear on the part of New
Mexico that rights subsequently established
might be claimed to be senior to the New
Mexico diversions. I don't think anybody
in Colorado felt this way about it. This is
to lay at rest the fear that the state of
New Mexico has, and I think it does it, and
I think it does it without injury to Colorado.
