..JJO/ 1 This is what section 602 tries to correct and we have worked now for eight years ~n an attempt to arrive at a proper formula. We have employed a number of consulting firms and we have had the best volunteer help that is available in colorado. This section 602 says that the Upper Basin has the right to store this water up here (pointing) to the extent necessary to protect itself from anticipated shortages, and we can demonstrate how those shortages would occur. Our first obligation is to deliver certain water, then secondly, we have the right to store the excess water even though they could use the water in the Lower Basin under Article III(e). We have established that by stating that a criteria must be developed which would take into account our anticipated shortages and that Glen Canyon has the first right after the delivery of this water to take the remaining water for storage. 1 Then we even qualified the matter fur- ther. We were not exactly content with that. We said 'Well, maybe the Secretary won't figure the shortages the same way that we will'. So we qualified that further and said that after this amount of water, say it's 12 million acre-feet that we anticipate that we must have in any given year against an anti- cipated shortage, we want to put some limita- tion upon the Secretary's authority. Even though this amount of water that is consider- ed necessary is stored in our upstream reservoirs, we still want a further right to store as against Hoover Dam and we will get additional water if Hoover Dam has more stor- age than Glen canyon. So even though we have what everybody agrees is safe storage, we can still increase that storage if there is more storage in Hoover Dam than there is in Glen. We put a qualification on our qualification and so far it has been accepted by the Lower Basin states but only after some very bitter negotiations.
