<br />..JJO/ <br /> <br />1 <br /> <br />This is what section 602 tries to correct <br />and we have worked now for eight years ~n an <br />attempt to arrive at a proper formula. We <br />have employed a number of consulting firms and <br />we have had the best volunteer help that is <br />available in colorado. This section 602 says <br />that the Upper Basin has the right to store <br />this water up here (pointing) to the extent <br />necessary to protect itself from anticipated <br />shortages, and we can demonstrate how those <br />shortages would occur. Our first obligation <br />is to deliver certain water, then secondly, <br />we have the right to store the excess water <br />even though they could use the water in the <br />Lower Basin under Article III(e). We have <br />established that by stating that a criteria <br />must be developed which would take into <br />account our anticipated shortages and that <br />Glen Canyon has the first right after the <br />delivery of this water to take the remaining <br />water for storage. <br /> <br />1 <br /> <br />Then we even qualified the matter fur- <br />ther. We were not exactly content with that. <br />We said 'Well, maybe the Secretary won't <br />figure the shortages the same way that we <br />will'. So we qualified that further and said <br />that after this amount of water, say it's 12 <br />million acre-feet that we anticipate that we <br />must have in any given year against an anti- <br />cipated shortage, we want to put some limita- <br />tion upon the Secretary's authority. Even <br />though this amount of water that is consider- <br />ed necessary is stored in our upstream <br />reservoirs, we still want a further right to <br />store as against Hoover Dam and we will get <br />additional water if Hoover Dam has more stor- <br />age than Glen canyon. So even though we have <br />what everybody agrees is safe storage, we can <br />still increase that storage if there is more <br />storage in Hoover Dam than there is in Glen. <br />We put a qualification on our qualification <br />and so far it has been accepted by the Lower <br />Basin states but only after some very bitter <br />negotiations. <br />
