<br />-2- <br /> <br />program. Currently the CWCB has $25K in spending authority for each fiscal year (i.e. on June 30th of <br />each year if there is any money remaining in the fund it reverts back to the general fund). Given that the . <br />weather modification program activities and funding may increase, the CWCB may desire to establish a <br />continuous appropriation for up to the balance of the fund so that if the fund exceeds $25K or is not <br />expended by June 30th of any give year, the Board may utilize the funds for its designated purposes. In <br />essence we are proposing to connect the newly established weather modification fund to the permit fees <br />collected from weather modification programs. <br /> <br />Recommendation <br />Staff recommendation is to: <br /> <br />(1) Revise this year's Projects Bill by adding a section that revises C.R.S. 37-60-121(3)(b). Below is <br />the text as the C.R.S. statute book currently reads. In bold and strikeout are the proposed changes. <br /> <br />(b) The board may accept, allocate, expend and otherwise use contributions and donations of <br />money, property, or equipment from any source to carry out the purposes of this article, <br />and sections 37-92-102 (3) and 37-60-124.4. <br /> <br />(2) Revise section 36-20-113 (1) of the C.R.S. Below is the text as the C.R.S. statute book currently <br />reads. In bold and strikeout are the proposed changes. <br /> <br />36-20-113 Permit fee. (1) The fee for each permit or the renewal thereof under section 36-20-114 shall <br />be at least $100. If the operation is a commercial project, the director shall set a fee that is sufficient to <br />pay the direct costs of review of the permit application, public hearings regarding the application, and . <br />monitoring a permit operation under the provisions of this article. Said fees are intended to provide at <br />least a portion of the moneys necessary to administer this article.
