The CWCBCIl!eraIlG \l!llt~ CIJIlSliIPI'litillll. <br />~, the State and Division Engineers, and their agents shaH have access to such measuring <br />device(s) at reasonable times in order to make readings therefrom. <br /> <br />(d) Breckenridge and the CWCB have entered into a Stipulation in this case <br />dated , 200 I, the terms of paragraphs 3-6 are herein incorporated by reference; <br />provided, however, Breckenridge and the CWCB may amend this Stipulation without leave of <br />Court or modification of this decree ifboth Breckenridge and the CWCB agree to such <br />amendment. <br /> <br />(e) The Court finds that the use of this water right in accordance with the <br />terms of this decree shall be nonconsumptive pursullUt to Ii 37-92-502, C.R.S., and that such <br />nonconsumptive use may occur despite the water right being out of priority. Decree of the Court. The foregoing paragraphs are hereby incorporated and made <br />a part of this Decree. The Court concludes that Breckenridge has satisfied all necessary legal <br />prerequisites and that the application for conditionalaboQhtv water rights described in paragraph <br />4 and the application for rights of exchange described in paragraph 5 are hereby approved and <br />granted. subject to the fmdings and tenus and conditions set forth herein.
