Imaging System <br /> <br />A Note on Executive Session Preparation: On January 12, Greg Walcher and I met with the <br />Attorney General's staff to discuss notice and preparation for the potential executive session discussions at <br />this meeting. We agreed to reword the agenda notice (Item 6 in our meeting agenda) to remove any <br />indication that the AG has already indicated a need for executive session discussion on the indicated <br />topics. Instead, the agenda indicates that the listed items may be taken up in executive session (along with <br />any other noticed items) if the Board concludes there is a need to do so. I have asked the AG's staffto <br />prepare a written summary of the cases that might be of interest to you, highlighting the status of the case <br />and the issues presented. That summary is included in your notebook and will be made available to the <br />public. It is intended to give each of us a better opportunity to identify any questions about litigation or <br />settlement strategies. If you have such questions, or others that are appropriate for review in executive <br />session, we hope you will have the information needed to raise them discreetly so that the full Board can <br />consider whether to take them up on executive session. If you have any questions, or need additional <br />assistance, please feel free to raise them with me or with Jennifer Gimble. <br /> <br />Federal and Interstate Issues <br />Due to time constraints, there is no "Federal Issues" agenda item during our board meeting. <br />Instead I have invited several key federal officials to have breakfast with us to allow you the opportunity <br />to get acquainted and discuss issues of mutual interest. <br /> <br />Keystone Ski Resort - 404 Permit Review: You may recall that snowmaking activities for the <br />Keystone Resort caused stream flow in the Snake River (tributary to the Blue River above Dillon <br />Reservoir) to drop below the 6 cfs protected by our water right last winter. This raised considerable <br />interest among the new media, environmental groups, and of course, with the US Forest Service and <br />Corps of Engineer's regulatory staff. You may also recall that we wrote Colonel Walsh in Sacramento last <br />November expressing concern that the Corps appeared to be intruding into state responsibility for water <br />supply allocations and duplicating our Stream and Lake Protection Program.
