Company <br /> <br />e <br /> <br />Case Summary <br /> <br />The Board ratified the Statement of Opposition filed in this case at its March 20-21, 1997, <br />meeting. This is an application for water rights and amended plan for augmentation on the Blue <br />River near Silverthorne in Summit County (see attached map). Prior to this application, <br />Applicant obtained a decree for a 3.0 cfs, senior water right at the Green Mountain Canal in Case <br />No. 5-88CW358 and a senior exchange from Green Mountain Reservoir to the Green Mountain <br />Canal in Case No. 5-88CW409. In the current case, Applicant requests a new, junior 3.0 cfs <br />water right at the Green Mountain Canal and an exchange from Green Mountain Reservoir to the <br />Green Mountain Canal for the purpose of transporting the water decreed in the previous cases to <br />the irrigable lands. <br /> <br />The Board has the following instream flow water rights which could be injured by this <br />application: <br /> <br />Case No. <br /> <br />Stream <br /> <br />Amount(cfs) <br /> <br />ADDroD. The additional 3.0 cfs water right decreed herein is junior to the Boards' instream <br />flow water rights. Applicant shall not operate the 3.0 cfs exchange decreed herein in <br />a manner that Will cause the flow of the Blue River in the stream reach between Green <br />Mountain Reservoir and the Green Mountain Canal headgate to fall below the decreed <br />minimum stream flow amounts set forth above. <br /> <br />. Applicants will install and maintain such measuring devices and implement such <br />accounting procedures as may be required by the Division Engineer to administer the <br />terms of this decree. The Colorado Water Conservation Board shall have access to <br />any such measuring device(s) at reasonable times to make readings therefrom. <br /> <br />e <br />
