<br />Agenda Item 8a(l) <br />Case No. 1-97CW256; Florissant Water and Sanitation District <br /> <br />e <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its January 28-29, 1998, meeting. <br />This is an application for groundwater rights, approval of a plan for augmentation, and an <br />exchange of water on the Middle Fork of the South Platte River and Sacramento Creek near <br />Florissant in Park County (see attached map). to augment out-of-priority depletions associated <br />with the operation of its well field, Applicant has purchased shares of capital stock in the <br />Mountain Mutual Reservoir Company, whiCh owns the Guiraud 3T Ditch and Lower <br />Sacramento Creek Reservoir No. 1. During the irrigation season, Applicant proposes to <br />replace depletions with consumptive use credits associated with the Guiraud 3T Ditch water <br />rights. During the non-irrigation season, Applicant proposes to replace depletions by releasing <br />water that has been exchanged from the headgate of the Guiraud 3T Ditch to the Lower <br />Sacramento Creek Reservoir No.1 under a priority date of February 28, 1980. Applicant <br />proposes a maxiInum exchange rate of 0.005 cf~. <br /> <br />The Board holds an instream flow water right (lll this segment of the Middle Fork of the South <br />Platte River for 16 cfs, summer, and 8 cfs, winter, with an appropriation date of January 30, <br />1980, and an instream flow water right on Sacramento Creek for 8 cfs, summer, and 3 cfs, <br />winter, with an appropriation date of July 9, 1975. <br /> <br />e <br /> <br />Stioulation <br /> <br />Applicant has agreed to the following terms and conditions, which will provide full protection for <br />the Board's instream flow water rights on Sacramento Creek and the Middle Fork South Platte <br />River. <br /> <br />. Applicant acknowledges that the Board's water rights on Sacramento Creek and the Middle <br />Fork South Platte River were decreed prior to the filling of the application in Case No. <br />97CW256. <br /> <br />. At times when the Board's instrearn flow water rights on either Sacramento Creek or the <br />Middle Fork South Platte River are not being satisfied, Applicant agrees to curtail the <br />exchanges under this plan for augmentation. <br /> <br />.
