Include the following language in the water court decree for said ISF water right: <br /> <br />The Board has determined that water is available for the full amount <br />decreed herein, taking into account the operation of Stagecoach Reservoir <br />consistent with its existing federal permits and/or licenses, the inflows into <br />Stagecoach Reservoir from the Yampa River, and the inflows from <br />Morrison Creek and side tributaries below Morrison Creek. However, the <br />Board recognizes that the Upper Yampa Water Conservancy District's <br />water rights in Stagecoach Reservoir are senior in priority to the instream <br />flow water right decreed herein, and that the operation of the Stagecoach <br />Reservoir and Dam in accordance with all applicable permits and licenses <br />may limit the availability of water for this instream flow water right. <br /> <br />2. The BLM, TU and the District agree not to oppose the above-described Staff <br />recommendation to the CWCB, and agree to withdraw their Notices to Contest upon <br />acceptance by the CWCB ofthat recommendation. The BLM, TU and the District <br />reserve the right to oppose any ISF recommendation or appropriation which is <br />inconsistent with the staff recommendation set forth in paragraph 1 herein. <br /> <br />3. The BLM, TU and the District agree to not oppose the entry of a decree for the <br />Yampa River ISF water rights that is consistent with all of the terms ofthis <br />stipulation. <br /> <br />4. This Stipulation constitutes the entire agreement and understanding between the <br />parties and supersedes any prior agreements or understandings related to the subject <br />matter of this Stipulation.
