STAFF RECOMMENDATION

For the Yampa River from the outlet of Stagecoiilch Reservoir to the confluence with Morrison
Creek, the staff reco~ends the Board not. pursu1 an instream flow appropriation for this stremA
segment and declare Its mtent to not appropnate an instream flow. .

For the Yampa River from the confluence of Morrison Creek to the inlet of Lake Catamount, the
staffrecommends that the Board: .

(I)

Determine. pursuant to section 37-92-102(3), CRS, and based upon the recommendation of
the CDOW, a review of the data and other information presented by the staff in this memo
and orally, that:

(a) A natural environment does exist;
(b) Water is available for appropriation; ,
(c) The natural environment will be preserved to a reasonable degree by the water
available for the recommended appropriation;
(d) There is a natural environment that can be preserved to a reasonable degree with the
recommended water right, if granted; and
(e) Such natural environment can exist ~ithout material injury to water rights.

(2) Date of Appropriation, pursuant to Rule 5.23, staff recommends the Board select July 24,
2001, as the date of appropriation for the Yampa River from the confluence of Morrison
Creek to the inlet of Lake Catamount segmeht.

(3)

Request the Attorney General's Office to file the necessary water rights applications.
