<br />STAFF RECOMMENDATION <br /> <br />For the Yampa River from the outlet of Stagecoiilch Reservoir to the confluence with Morrison <br />Creek, the staff reco~ends the Board not. pursu1 an instream flow appropriation for this stremA <br />segment and declare Its mtent to not appropnate an instream flow. . <br />! <br /> <br />For the Yampa River from the confluence of Morrison Creek to the inlet of Lake Catamount, the <br />staffrecommends that the Board: . <br /> <br />(I) <br /> <br />Determine. pursuant to section 37-92-102(3), CRS, and based upon the recommendation of <br />the CDOW, a review of the data and other information presented by the staff in this memo <br />and orally, that: <br /> <br />(a) A natural environment does exist; <br />(b) Water is available for appropriation; , <br />(c) The natural environment will be preserved to a reasonable degree by the water <br />available for the recommended appropriation; <br />(d) There is a natural environment that can be preserved to a reasonable degree with the <br />recommended water right, if granted; and <br />(e) Such natural environment can exist ~ithout material injury to water rights. <br /> <br />(2) Date of Appropriation, pursuant to Rule 5.23, staff recommends the Board select July 24, <br />2001, as the date of appropriation for the Yampa River from the confluence of Morrison <br />Creek to the inlet of Lake Catamount segmeht. <br /> <br />(3) <br /> <br />Request the Attorney General's Office to file the necessary water rights applications. <br /> <br />Yamna River Final StaffRecomrnendation.doc <br /> <br />Flood Control and Floodplain Management -Larry Lang, Chief.
