Application Summary

This is an application for surface and ground water rights, change of water rights, and approval of
a plan for augmentation near Carbondale. Applicant seeks to adjudicate water rights for a
number of ditches and wells, and a water right for the Iron Rose Ranch Pump and Pipeline for 4
cfs, absolute, with an appropriation date of 1/1/2001 for irrigation, stock watering, and year-
round piscatorial, recreation, and fish propagation, Applicant also seeks to change the point of
diversion of three ditches to the Iron Rose Ranch Pump and Pipeline, as an alternate point of
diversion. Applicant seeks approval of a plan for augmentation to replace out-of-priority uses of
water from the above-described structures, including depletions due to year-round diversion from
certain structures, Applicant's sources of augmentation water include releases from Ruedi and
Green Mountain Reservoirs.

Potential for Injury:

Applicant's proposed change of water rights may constitute an expansion of use and cause
material injury to the Board's instream flow water rights on the Roaring Fork River. Applicant's
proposed plan for augmentation may injure the Board's instream flow water rights on the Roaring
Fork River by not replacing out-of-priority diversions and / or depletions in time, place and
amount.
