<br />-4 - <br /> <br />in the management of the Construction Fund and Severance Tax Trust Fund <br />Perpetual Base Account be used for Personal Services expenditures within the <br />operations ofthe CWCB. <br /> <br />37-60-119(2) Colorado Revised Statutes, is amended to read: <br /> <br />37-60-119 (2) The board may, subject to the provisions in section 37-60-122, enter into contracts for <br />the use of, or to loan moneys to enable the construction, rehabilitation, enlargement, or improvement <br />of, said flood control, water, power, and any related recreational facilities, excluding domestic water <br />treatment and distribution systems, with any agency or political subdivision ofthis state or the <br />federal govemment, with individuals, with corporations, or with organizations composed of citizens <br />of this state. Any such contracts may provide for such charges to the using entity as, in the opinion <br />of the board, are necessary and reasonable to recover the board's capital investment, together with <br />operational, maintenance, and interest charges over the term of years agreed upon by contract. <br />Interest charges shall be recommended by the board at between zero and seven percent on the basis <br />of the project sponsor's ability to pay and the significance of the project to the development and <br />protection of the water supplies ofthe state. Interest charges shall be credited to and made a part of <br />the Colorado water conservation board construction fund. Any other charges, as determined <br />appropriate by the board, shall be continuously appropriated to the Colorado water conservation <br />board for supplemental operational AND PERSONAL SERVICES expenditures. <br /> <br />Discussion <br /> <br />This revision relative to where the interest charges and other charges are credited, refers to <br />the Board's levying of application fees, loan origination fees, or other fees pertaining to the <br />administration of the Construction Fund loan program. The monies collected from such fees would <br />be credited, in addition to the operational account of the Board, to Personal Services that are used for <br />permanent and temporary staff salaries and benefits. When an employee quits or retires from State <br />service, his or her annual and sick leave benefits must be paid from the specific agency's Personal <br />Services budget. If the retiring employee has been a long-term employee with significant accrued <br />leave benefits, the Personal Services budget is sometimes impacted to the point that the agency can't <br />immediately fill the position. Not filling the position immediately allows the Personal Services <br />budget to recover, however it has a negative impact on services provided to the State's water users. <br />Specifically in the case of the Construction Fund, a vacant position means interrupted services to the <br />water users as well as negative impacts to the revenue stream used to drive the entire CWCB <br />operations. The addition of the bold language above would allow the CWCB to supplement its <br />Personal Services budget and allow uninterrupted service to the State's water users in the event of <br />Personal Services budget shortfalls. <br /> <br />Flood Protection.
