Action: A motion was made by Eric Kuhn to make a preliminary action to move
to final notice subject to the following terms and conditions: a 100,000
acre foot carve-out; don't define a monthly distribution yet, but have it be
subject to the determinations of terms and conditions to be figured out
after filing; that it be modifiable, would move from 242 total, or if you
will, the entitlement portion would move from 142,000 to 300,000 acre
feet, for a total of 400,000 acre feet. That the base flow would be 581 in
October, 1240 November through April, 2,000 May through June, up to
1240 in July, and 581 in August and September. The base flow would not
be subordinated, and it would be one day senior to the recovery flow, and
the recovery flow would be explicitly modifiable or else subject to
withdrawl and nonenforcement in the event it proves not to be modifiable,
and that would be determined before the Board takes final action
December 13, 1995. It would be subject to the development of explicit
modifiability criteria, and to the degree possible, this would be determined
before December 13, 1995, and the recovery flow would be in an amount
of either all the remaining water after the compact carveout or the
alternative, a set of cubic feet per second numbers that are based on the
25% exceedence. The motion was seconded by Patricia Wells and
approved unanimously (8-0).

Action: The staff will move this item to final notice at the CWCB November 6-7,
1995 meeting, CWCB staff will have meeting prior to 12/13/95 special
meeting when the Board will take final action on this item.
