It provided for the extension, amendment, or termination of the Agreement with the <br />concurrence of all of the signatories, or allowed any signatory to withdraw from the <br />Agreement upon written notice to the other signatories. <br /> <br />Discussion <br /> <br />The SJRIP, as indicated in the background information above, is a key component of the <br />environmental commitments made by the U.S. Bureau of Reclamation that allowed the <br />Animas-La Plata Project to proceed and thus helped to complete the Ute Indian federal <br />reserved water rights settlement. The SJRIP has also become the "reasonable and <br />prudent alternative" that the U.S. Fish and Wildlife Service can rely on for its "Section 7" <br />consultations. <br /> <br />The SJRIP has been working on revisions to the program documents for the last few <br />years and given that the Agreement will expire in 2007 has elected to seek an extension <br />of the Agreement through 2023 and prior to completion of the program documents. The <br />year 2023 was selected because that is year in which recovery of the endangered fish is <br />presently projected to occur. <br /> <br />Attached is a copy of the Agreement that staff is requesting be extended. We have also <br />attached a copy ofthe agreement extending the Upper Colorado River Recovery <br />Implementation Program for your information. We are proposing the same form of <br />extension agreement for the SJRIP. We fully anticipate that all the other signatories to <br />the Agreement will agree to extend the SJRIP. <br /> <br />We would note that no additional funding is required other than that necessary for staff to <br />attend and participate in the SJRIP committees. The Department of Interior through the <br />U.S. Bureau of Reclamation provides the annual operating budget for the SJRIP. <br /> <br />The proposed extension, we believe, has the full support of the Southwest Water <br />Conservation District. <br /> <br />Staff Recommendation <br /> <br />Staff recommends that the Board recommend to the Governor that he sign the proposed <br />extension of the Cooperative Agreement for the San Juan River Basin Recovery <br />Implementation Program. <br /> <br />Flood Protection.
