<br />... <br />,;,J, <br /> <br />SUBJECT: <br /> <br />DRAFT POLICIES INVOLVING PROPOSED APPLICATIONS <br />FOR RECREATIONAL IN-CHANNEL DIVERSIONS <br />("RICDs") <br /> <br />EFFECTIVE DATE: November 19.2001 <br /> <br />PURPOSE: The Colorado Water Conservation Board (CWCB), pursuant to <br />sections 37-92-102(5), 37-92-102(6) & 37-92-305(13), C.R.S. <br />(2001), is required to file with a water court fmdings of fact and <br />recommendations regarding an application for a Recreational In- <br />Channel Diversion. The purpose of these policies is to provide a <br />voluntary process whereby entities seeking to apply for RICDs <br />may obtain informal comments from the Staff, the Board, and the <br />public, should they ehoose to pursue this infermal process. This <br />policy is adopted to encourage collaboration between applicants <br />for RICDs and the CWCB Staff in order to develop sHflerior <br />unobjectionable RICD applications and to provide ample time for <br />exploration of issues of potential concern. <br /> <br />APPLICABILITY: The policy and procedure shall apply to all RICD proposals <br />applicatiolis for recreatioFlal ili eharmel diyersions prior to any <br />RICD ap,plication being filed with a water court, <br /> <br />POLICIES: 1. Any entity that is considering filing an RICD application <br />fer a Recreational In Channel DiYersion ("RICD") may elect to <br />discuss its proposal with submit a copy of the propesed liflplieation <br />te-the Staff of the CWCB fer its review and input. Staff will <br />review and evaluate any proposaled liflplieatiolls ill a timely <br />marJier within thirty days ofreceivin~ a request for an informal <br />evaluation. In addition, the Staff shall effer to meet with an <br />awlieant to discuss the proposed aJlfllieatien and any eOlieems the <br />Staff has ahout it. <br /> <br />2. IfaAIl elltity that is considering filing a proposed RICD <br />ap,plication is interested ili may obtainiHg Board andlor public <br />input on the proposaled RICD," Tthe Staff should will <br />accommodate such requests by developing a preliminary staff <br />recommendation, and by notifying the public by including the item <br />on a the next regularly scheduled Board agenda. <br /> <br />3. +At an ap,plicant's request. the Board shall allow an entity <br />considering filing a proposed RICD ap-plication to present its <br />proposaled aJlfllicatioli to the Board at any the next regularly <br />scheduled Board meeting, or at any special subsequent Board <br />meeting. <br />
