<br />SEC, 106, Conservation and development of the fish and wildlife resources and the enhancement
<br />of recreation opportunities in connection with the Closed Basin Division of the San Luis Valley
<br />project works authorized by this Act shall be accordance with the provisions of the Federal Water
<br />Project Recreation Act. (70 Stat. 213)
<br />SEC, 107, The Secretary is authorized to transfer to the State of Colorado or to any qualified
<br />agency or political subdivision of the State, or to a water users' organization, responsibility for the
<br />care, operation, and maintenance of the project works, or any part thereof, The agency or
<br />organization assuming such obligation shall obligate itself to operate the project works in
<br />accordance with regulations prescribed by the Secretary,
<br />SEC, 108, Nothing contained in this Act shall be construed to abrogate, amend, modify, or be in
<br />confiict with any provisions of the Rio Grande compact, or to shift any legal burden of delivery from
<br />the Rio Grande or the Conejos River to the Closed Basin.
<br />SEC, 109, There is hereby aulhorized to be appropriated the sum of $94,000,000 (October 1988
<br />prices) for the construction of the Closed Basin Division of the San Luis Valley project, of which
<br />amount not more than $31,000,000 may be adjusted plus or minus such amounts, if any, as may
<br />be justified by reason of ordinary fluctuations in construction costs as indicated by engineering cost
<br />indices applicable to the types of construction involved herein, and such additional sums for the
<br />operation and maintenance of the project as may be required: Provided, That none of the funds
<br />authorized herein for construction in excess of $75,000,000 may be expended by the Secretary
<br />unless and until the State of Colorado or a political subdivision thereof has entered into a binding
<br />agreement with the Secretary to contribute during construction one-third of the costs of construction
<br />in excess of $75,000,000 or $6,000,000, whichever is less, Such agreement shall include a
<br />reasonable limitation on administrative overhead expenses charged by the Secretary,

<br />SECTION 2, Additional project authorization, Pursuant to section 37~0-122 (1)
<br />(b), Colorado Revised Statutes, the Colorado water conservation board is hereby
<br />authorized to enter into a binding agreement with the Secretary of the United
<br />States department of the interior to contribute, on a nonreimbursable basis, one-
<br />third of the costs of construction of the federal closed basin project in excess of
<br />seventy-five million dollars ($75,000,000) or six million dollars ($6,000,000),
<br />whichever is less, said sum to be expended from such moneys as are, or may
<br />hereafter become, available to the Colorado water conservation board
<br />construction fund.
