As a result, the Board approved the <br />proposed solution with agreement by both Pinon Mesa and RMI. <br /> <br />A new Board of Directors for Pinon Mesa was elected. <br /> <br />A meeting was held at Pinon Mesa with RMI and CWCB staff to discuss details <br />of the proposed project resolution. All of the parties were in agreement with the <br />details of the resolution. <br /> <br />A hostile letter was received by RMI from Pinon Mesa regarding a dispute over <br />the project construction schedule and quality of work. <br /> <br />Pinon Mesa filed a lawsuit against RMI alleging non-compliance with their <br />construction contract. <br /> <br />A settlement was proposed by Pinon Mesa with a schedule for project <br />completion by March 2000. <br /> <br />The project was inspected by CWCB staff and it was determined that the project <br />site and construction materials had deteriorated to a point where substantial <br />work would be required to complete the project as designed. <br /> <br />RMI refused Pinon Mesa's settlement proposal. <br /> <br />The Pinon Mesa Board of Directors and shareholders attempted to complete the <br />construction project on their own resulting in disabled construction equipment <br />and a personal lawsuit filed by the Pinon Mesa secretary-treasurer against the <br />past-president. <br /> <br />The CWCB notified Pinon Mesa that it was in default on the loan. The <br />notification also included a request for payment of interest during construction, <br />and an amortization schedule for loan repayment. <br /> <br />The CWCB sent a 2nd Notice of project repayment to Pinon Mesa. <br /> <br />A telephone conversation between the CWCB staff and the new Pinon Mesa <br />president was held where the president assured the staff that Pinon Mesa's <br />intentions were to repay the loan after a shareholder meeting in October. <br /> <br />The CWCB staff inspected the project and found that the past-president's <br />property, where the small storage reservoir is located, was for sale. <br /> <br />An inquiry was made by a third party to purchase the remaining Pinon Mesa <br />project assets and to try to revive the project. No follow-up inquiry has been <br />received to date. <br /> <br />Several miscellaneous unsuccessful attempts were made by the CWCB staff to <br />contact Pinon Mesa board officers to determine the current status of the project <br />or the association. <br /> <br />Flood Protection.
