Other types of federal land withdrawal or designation, including conservation <br />areas, recreation areas, national rivers, and similar designations, carry with them the risk of an <br />implied reserved water right. <br /> <br />5. An Outstanding Natural Area has been used at least once before to produce a <br />management scenario where the bulk of the property was privately owned, but the federal <br />interests were significant. That situation occurred at Yaquina Head in Oregon. <br /> <br />6, The legislation specifically disavows a federal water right and specifically finds <br />that water supply for the area will occur as the result of Colorado's compact compliance, and not <br />otherWise. <br /> <br />7-. _, 1he legi~la!i{)n.re:cognizesj'h.ata_m~u.m s!reaglf1ow,could be apprQPp';1te: i)l !h~ ' <br />area, but the same would be obtained by the Colorado Water Conservation Board under <br />Colorado law. <br /> <br />8. The legislation provides for the withdrawal of the federal land (approximately <br />one-third (113) of the total land within the Outstanding Natural Area) from other fonus of entry <br />and use, and makes it clear that the purpose of the legislation is to protect this area in relatively <br />pristine condition and to develop planning mechanisms so that private property owners can also <br />participate in the restoration and protection of the corridor. <br /> <br />9. Within Colorado, almost all groups that have been contacted have been <br />supportive, including the San Luis Valley Ecosystem Council, the San Luis Valley Cattlemen's <br />Association, and all ofthe County Conunissioners within the county.
