statutes when a compact is entered into with
another state.

The Upper Colorado River Compact was
entered into and is set forth in 148-8-5 and I
provides among other things for the creation
of an Upper Colorado River Commission. This
Commission is, by the terms of the compact,
to be selected under state law and the President
of the United States to designate the federal
representative. Under the statute which rati-
fied this compact, adopted by our Legislature,
the Colorado member of the Commission is
appointed by the Governor and serves until
revocation of his appointment by the Governor.
On behalf of the Commission, the State of
Colorado shall pay his necessary expenses and
also compensation in the amount fixed by the
Governor.

Mr. Stapleton called me this morning and
wanted me to point out these provisions of the
statutes so everyone has clearly in mind whose
duties pertain to what. The Upper Colorado
River Commission is not connected with this
Board in any way and the Commissioner is ap-
pointed by the Governor. I might say this,
some confusion may arise because of the fact
that historically the budget for the Upper Colo-
rado River Commission has been included in the
Water Conservation Board's budget. It is a
separate item. This was done administratively.
The money goes directly, as I understand it,
and has historically gone directly, to the
Upper Colorado River Commission for these pur-
poses.

Is there anything else that you would like
to have clarified, Mr. Stapleton?"

"I'd like to have this clarified. It has
been my understanding and I accepted my appoint-
ment and I presume other members did too, on the
basis that the Colorado Water Conservation
Board, of which the Governor is a member, sets
