<br />e <br /> <br />e <br /> <br /> <br />e <br /> <br />Consent Agenda Item 1z <br />Case No. 5-02CW403; Upper Eagle Regional Water Authority <br /> <br /> <br />Application Summary <br /> <br />This is an application for a change of water rights and augmentation plan near the Town of <br />Edwards. (please see the attached map). The Applicant seeks to divert its water rights at an <br />upstream point of diversion and to change the type of use. <br /> <br />CWCB Appropriations <br /> <br />The Board holds the following instream flow water rights that could be injured by this <br />application: <br /> <br />Case No. <br />5-80CW126 <br />5-80CW124 <br /> <br />Stream/Lake <br />Eagle River <br />Eagle River <br /> <br />Amount (cfs/at) <br />110/45 <br />130/50 <br /> <br />Ap1;Jropriation Date <br />3/17/1980 <br />3/17/1980 <br /> <br />Potential for Iniury <br /> <br />The Applicant's proposed change of water rights may injure the CWCB's instream flow water <br />rights by diverting at the upstream point of diversion when the CWCB's intervening instream flow <br />water rights are not being satisfied. In addition, an expansion of this water right could injure the <br />CWCB's instream flow water rights. Also, the Applicant's proposed augmentation plan may not <br />adequately replace depletions in time, place, and amount. <br /> <br />Other Objectors <br /> <br />The other objectors in this case include: the Homestake Project; the Squaw Creek Metropolitan <br />District; the City and County of Denver; the Eagle County Board of County Commissioners; Excel <br />Energy; and the State Engineer and the Division Engineer for Water Division No.5. <br /> <br />L:\Section Folders\SECC\Case Files\2002\502CW403 _IDem.doc <br />
