To address the problems caused by WD, the division has <br />_begUn a hatchery modernization program. <br /> <br />The vote on the fish hatchery bill was 4-2. Sen. Dennis and Rep. Chlouber opposed the bill. Sen. Dyer, <br />Rep. Larson, Rep. Plant and Rep. Stengel opposed the bill. We are <br />working on study proposals with the local governments to address these requests. <br /> <br />Gagging Plan: A memo is attached. It is intended to give you an idea about how we are progressing <br />towards the development of a five-year plan to address an on-going need. We intend to make a recommendation <br />to you in January. <br /> <br />Dam-site Information Posted to Internet: The dam site inventory information that was sent to county <br />planners on Sept. 5 has been posted on our Internet website. The inventory was based on a review of the State <br />Engineer's tabulation of conditional storage water rights and a review of over 35 published water resource <br />development studies and reports. The inventory does not include every potential reservoir site. We hope local <br />planners will use the information when confronted with decisions to permit development in areas where water <br />storage facilities could be located. The draft river basin "fact sheets" and the "Planning for Drought." Booklet <br />(that contains historical information about past droughts for each river basin and some general <br />recommendations) are also on the Internet at www.cwcb.state.co.us. <br /> <br />Local Water Basin Planning & Fact Sheets: Cat Shrier has prepared a draft set of "bullets" that <br />attempt to describe the issues raised at the meetings thus far. The information is attached. <br /> <br />,/ <br /> <br />t <br /> <br />,-;: <br />~ <br />p <br /> <br />- <br /> <br />Water Quality Consultation: In response to the Water Quality Control Commission's (WQCC) request <br />for consultation, on Oct. 25 Hal Simpson and I sent a letter to the WQCC commenting on the proposed <br />revisions to the water quality classifications, standards, and designations for multiple segments in the South <br />Platte River Basin, Laramie River Basin, Republican River Basin, and Smokey Hill River Basin (Regulation <br />#38). Pursuant to Section 25-8-104, C.R.S., we reviewed the proposed revisions, including the parties' pre- <br />hearing and rebuttal statements to evaluate potential impacts on the water rights and water development. <br />Additionally, our staffs participated in part of the WQCC' s rulemaking hearing. <br /> <br />A total of 45 entities sought party status for this hearing. Several entities raised concerns about potential <br />impacts on water rights if the proposed revisions were adopted. These concerns are summarized below: <br /> <br />. Gaps in regulation of effluent-dominated ambient waters might limit the amount and availability of water for <br />diversion because of increased risk to human health and/or the ability to treat water. <br />. Insufficient regulation of effluent-dominated stream segments classified for water supply use might result in <br />potential increase in costs associated with water diversion and use in accordance with decreed water rights. <br />. The proposed numeric standards and reclassification of certain stream segments could prevent existing <br />exchanges of treated wastewater as a "substitute supply" for upstream, out-of-priority diversions. <br />. The proposed revisions may impact the ability to reuse transmountain return flows and reclaimed water <br />through exchanges, substitution, or augmentation. <br />. The new classifications for certain stream segments could result in restrictions on non-point source <br />discharges, potentially impairing an owner of a vested water right to apply water to beneficial use. <br /> <br />We informed the WQCC that the CWCB and DWR have traditionally relied on the expertise and <br />judgement of the WQCD staff and the WQCC to adopt scientifically appropriate and economically reasonable <br />standards and classifications. The provisions of 37-80-120(3) and 37-92-305(5) C.R.S. provide that with respect <br /> <br />7 <br />
