Review of Revised "Guidelines for Financial Assistance through the
Colorado Water Conservation Board Construction Fund"

Introduction

Pursuant to Section 37-60-122, C,R,S., the Colorado Water Conservation Board (CWCB),
through its policies and procedures, requires that all projects funded through the Construction Fund
and Severance Tax Trust Fund Perpetual Base Account have a completed feasibility study prior to
loan consideration by the Board. Those policies state that all feasibility studies will be prepared
following the general procedures described in the Board's Construction Fund Guidelines
(Guidelines).

This agenda item is a review of the Guidelines and a presentation of proposed revisions to the
Guidelines,

The Legislature has given the Board sole discretion, subject to such procedures as the Board
deems appropriate, for the review and approval of project feasibility studies completed as part of a
loan application from the Construction Fund and the Perpetual Base Account.

Section 37-60-122 (c), C.R.S requires that a feasibility study be prepared for projects
requesting Construction Fund loans in order to determine the economic and engineering feasibility
of the project. Further, Section 37-60-121 (b), C.R.S" requires that the feasibility study for the
proposed project shall include an evaluation of: the water tights available to the project and the yield
thereof; the engineering and economic feasibility of the proposed project; and the anticipated
economic, social and environmental effects ofthe project.
